RushPay Fintech Group Ltd provides digital payment facilitation services as-is through our Bank of Ghana licensed payment partner. While we strive for accuracy and reliability, we make no warranties regarding uninterrupted service, error-free operations, or specific results. However, your funds remain secure with our licensed payment partner regardless of service availability.
2. Regulatory Status and Operations
RushPay Fintech Group Ltd is a legally registered fintech business in Ghana. We operate through a Bank of Ghana licensed payment service provider who processes all transactions and holds user funds in compliance with regulatory requirements.
What This Means for You:
- Your funds are held by a Bank of Ghana licensed entity, not by RushPay directly
- All transactions are processed through regulated payment infrastructure
- Your money is protected by Ghana's financial regulatory framework
- We are in the process of acquiring our own payment service provider license
- We comply with all applicable Ghanaian financial regulations
RushPay does not provide banking services, we facilitate digital payment transactions through licensed partners.
3. Fund Safety Assurance
Your Money is Safe: Because your funds are held by our Bank of Ghana licensed payment partner (not by RushPay), they remain secure and accessible even if:
- RushPay experiences business disruption or operational challenges
- Natural disasters or unforeseen events occur
- There are changes in RushPay's business structure
Protected by Regulation: The separation of customer funds from RushPay's operations provides an additional layer of security mandated by Bank of Ghana regulations.
4. Not Financial Advice
RushPay provides payment infrastructure, not financial, investment, tax, or legal advice. Consult qualified professionals for such matters.
5. Transaction Risks
- User Responsibility: You are responsible for verifying recipient details before initiating transfers. RushPay cannot reverse completed transactions.
- Network Delays: Bank and mobile money network delays are beyond our control
- Fraud Risk: Protect your credentials. RushPay will never request your PIN via email, SMS, or phone
- Account Verification: Unverified accounts may have limited functionality
6. Third-Party Services
RushPay integrates with a Bank of Ghana licensed payment partner, banks, and mobile money operators. We are not responsible for their service interruptions, policy changes, or errors. Issues with external services should be directed to those providers. However, your funds remain protected by regulatory frameworks.
7. Limitation of Liability
To the fullest extent permitted by law, RushPay Fintech Group Ltd is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages exceeding the fees paid for the specific transaction in question
- Service interruptions due to maintenance, updates, or technical issues
- User errors, negligence, or unauthorized account access
Note: Since we do not hold user funds directly, your money remains protected by our licensed payment partner even during RushPay service disruptions.
8. Force Majeure
RushPay is not liable for delays or failures caused by events beyond our reasonable control including natural disasters, pandemics, government actions, network outages, cyber attacks, or civil unrest. Your funds remain safe with our licensed payment partner during such events.
9. Fees and Charges
Withdrawal Fees:
- Mobile Money: GH₵2.00 per transaction
- Bank Transfer: GH₵10.00 per transaction
- Payroll: Same rates apply (GH₵2.00 for mobile money, GH₵10.00 for bank)
User-to-User Transfer Fee:
- Weekly Service Fee: GH₵1.00 per week (charged to both sender and receiver)
- Fee applies once per week regardless of transfer amount or frequency
- Unlimited transfers within the week after paying the fee
All fees are clearly displayed before transaction confirmation. Additional charges by banks or mobile money operators (beyond our control) are their responsibility, not RushPay's. Deposits are free.
10. Account Security
Important Security Notice:
- Never share your PIN or OTP codes with anyone
- RushPay staff will NEVER ask for your PIN
- Beware of phishing attempts via fake emails or SMS
- Always verify you're on the official RushPay website (rushpay.cash)
- Report suspicious activity immediately
- Your funds are held by our licensed partner, adding an extra layer of security
11. Prohibited Activities
RushPay prohibits use of our services for:
- Money laundering or terrorist financing
- Fraud, scams, or illegal gambling
- Purchase of illegal goods or services
- Ponzi schemes or pyramid schemes
- Any activity violating Ghanaian laws
Violators will face account suspension and potential legal action.
12. Service Modifications
RushPay reserves the right to modify, suspend, or discontinue any feature or service with reasonable notice. We are not liable for any modification, suspension, or discontinuation. Your funds remain safe with our licensed payment partner during any service changes.
13. Exchange Rates
Where applicable, exchange rates are provided by third-party providers. RushPay is not responsible for rate fluctuations.
14. Giftcard Disclaimer
Giftcards are subject to issuer terms and conditions. RushPay facilitates purchases but is not responsible for giftcard validity, redemption issues, or issuer policy changes.
15. Payroll Services
Businesses using payroll services are responsible for:
- Accuracy of employee data and payment amounts
- Compliance with Ghana's labor and tax laws
- Sufficient funds for bulk payments (processed through our licensed payment partner)
- Employee consent for payment method
Payroll Fees: GH₵2.00 for mobile money, GH₵10.00 for bank transfers per employee.
16. QR Code Payments
Merchants are responsible for displaying accurate QR codes. Customers should verify payment details before confirming transactions. All QR transactions are processed through our licensed payment infrastructure.
17. Dispute Resolution
While we investigate disputes in good faith, our decisions are final unless overturned by regulatory authorities or courts. Disputes involving fund custody will be handled in conjunction with our licensed payment partner.
18. No Guarantee of Availability
RushPay does not guarantee continuous, uninterrupted, or secure access to services. Scheduled and emergency maintenance may occur. However, your funds remain accessible through our licensed payment partner even during RushPay service interruptions.
19. User Content
Users are responsible for data they input into RushPay. We are not liable for errors in user-provided information.
20. Links to External Sites
RushPay may contain links to third-party websites. We are not responsible for their content, privacy practices, or security.
21. Indemnification
You agree to indemnify RushPay Fintech Group Ltd against claims arising from your violation of these terms, applicable laws, or third-party rights.
22. Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
23. Entire Agreement
These terms, privacy policy, and disclaimer constitute the entire agreement between you and RushPay Fintech Group Ltd.
